On 10 October 2002, the International Court of Justice (ICJ) at the Hague ceded to Cameroon the Bakassi peninsula, an oil-rich island on the West African coast, whose ownership had been disputed by Nigeria and Cameroon for over two decades.

The Obasanjo administration in Nigeria rejected the court judgement. This raised tension in the area and the possibility of a military conflict. Both Nigeria and Cameroon stationed their troops on the island but in the long run Cameroon won after winning its case to International/THIRD-PARTY involvement.

The case was won by Cameroon since Nigeria relied on the idea that following its mainland boundary would be vital in the case and ended up submitting a weak case.

BANGLADESH and India

Bangladesh, realizing the importance of the issue for its future maritime endeavours, and aware of the hiccups involved in bilateral dispute resolution, decided to opt for international mechanisms. It may be noted that India has always emphasized on bilateral mechanisms for resolution of problems with its smaller neighbours.

It has always stood against international/third-party involvement, particularly in the case of Pakistan. However, Bangladesh not only managed to convince India to accept third-party arbitration, but also won its case favourably. The acceptance of arbitration by both the parties means that the verdict is final and binding.

Bangladesh managed to achieve this success only because it took the task seriously and did its homework correctly.

SOMALI will most likely lose the case

Maritime cases take longer to get a settlement. They also require one to have done some good homework before involving international arbitration since acceptance of arbitration by both the parties means that the verdict is final and binding; It cannot be challenged in any other forum.

Weak Case

Experts in law who have seen the 150-pages case submitted stated that the case is weak and not strong enough for Somalia to win it in the end. One expert said that it is lacking the history of the Somalia maritime boundaries and has been indicated in the case that the dispute has been going on for decades.

Other sources have said that the Somali Federal government wrote that the territorial waters are only 12 nautical miles contrary to law No. 37 of September 10, 1972 which states Somalia’s territorial sea is by breadth 200 nautical miles.

Nadal was issued two separate TUE certificates – in 2009 he was allowed to use the banned drug betamethasone, and then in 2012 he received further clearance to take corticotrophins.

WADA has confirmed the authenticity of the fresh documents unveiled by the hackers.

“The World Anti-Doping Agency (WADA) confirms that, again today, the cyber hacker Group ‘Fancy Bear’ released a batch of confidential athlete data on their website, which they illegally obtained from a Rio 2016 Olympic Games account of WADA’s Anti-Doping Administration and Management System (ADAMS).”

The latest crash of a police helicopter was caused by an unqualified pilot who failed to respond appropriately when a marabou stork flew dangerously close, investigators say.

He pushed the wrong lever, members of the investigating team told the Star. As a result, the aircraft lost power, stalled and created a vortex that pulled the Sh683 million chopper down.

The crash 11 days ago in Mathare area of the newly acquired aircraft was the fifth of a police plane or helicopter between August and September this year.

The toll raises questions about the quality of recruitment and training, among other issues.

Last Friday, investigators interviewed the four survivors. Investigators were drawn from the Kenya Civil Aviation Authority; AgustaWestland of South Africa, subsidiary of the Italian manufacturer Finmeccanica; the Air Crash Investigation Department of the Ministry of Transport and Infrastructure.

The pilot said to have been flying the helicopter, Inspector Dennis Oduk, allegedly said his colleague Inspector Martin Ndungu was in control.

The two were among six trainees out of 10 who were considered by the Italian manufacturer not competent to pilot the aircraft — only to be copilots. Four of 10 were considered qualified. They received training in Italy.

Inspector Ndungu, undergoing treatment at the Nairobi West Hospital, and engineer Michael Kariuki, who was also on board, did not provide information. They are understood to have said they could not remember anything.

The fourth person aboard was identified as engineer Mandip Oshan seconded to the Kenya Police Service by the Italian manufacturer.

Oshan is understood to have told investigators Oduk was at the controls and did not know how to respond when a marabu stork flew near. It was attracted by the nearby dumpsite, posing the danger of a bird hit.

Members of the investigating team, speaking to the Star in confidence, said the account given by Mandip from his bed at Aga Khan hospital tallies with information from the flight data recorder.

AFC Leopards club officials have begged female fans to stop bombarding players with free sex after it emerged that three first-team players underwent treatment last week for a sexually transmitted infection.

The officials are concerned that the sex orgies after matches are affecting team discipline, which has made some players unavailable for the crucial match against Western Stima, as they are currently undergoing treatment for an STI.

The Nairobi News has confirmed from a number of sources within the club’s hierarchy that the trio, a goalkeeper, defender and midfielder, were all diagnosed with the ailment last week and consequently went for treatment with the club footing the bill.

INFECTED BY FAN

Further reports suggest that the players are almost certainly believed to have been infected after sleeping with one female fan during an orgy.

“The players have confessed to ‘roasting’ one woman who is an ardent fan of the club affiliated to the branches, an Ingwelett,” a top club official who spoke to Nairobi News on a condition of anonymity said.

“Thus, we have talked to the players about self discipline, and even asked the branch officials to try and control the fans from intimately interacting with the players,” the official added.

The decision by the club’s management to engage its branch officials over the matter was arrived at following a national executive committee meeting held in Nairobi on Tuesday evening.

Nairobi Governor Evans Kidero yesterday endorsed President Uhuru Kenyatta for a second term in office, albeit mistakenly.

Kidero was speaking during the official opening of the 2016 Nairobi International Trade Fair. He was in the process of thanking the president for gracing the occasion every year, listing the years 2013, 2014, 2015, 2016 and then proceeding to state that he is ‘definite and confident’ that he will be there in 2017.

If things remain as they are, Kenyans will go to the ballot on August 8, 2017, a whole two months before next year’s trade fair. So, we’ll either have a new president or Uhuru will be serving his second term.

Unless Kidero knows something we don’t about the election date, he may have just ‘endorsed’ Uhuru.

Even the President was glad for the vote of confidence, expressing hope that Kidero’s prayer will be answered.

Terror group Al-Shabaab attack innocent Kenyans at Mandera County on Thursday 6th killing civilians.

Six people were killed as police managed to rescue 27 people. The attack at Bulla public works in Mandera was attacked by a group of Al-Shabaab militia at around 2:45am in the morning.

The ambush on civilians is believed to have targeted non–locals living near the Somali border.
